whatnext.law has launched, in partnership with TEK Notícias, the weekly column “Fair Markets of the 21st Century”, dedicated to analysing regulatory developments that are transforming the digital economy. The initiative stems from an international academic conference organised by whatnext.law on Fair Markets in the 21st Century — Digital transition, artificial intelligence and technological neutrality, set against a backdrop marked by the debate on the simplification of digital regulation, growing concerns surrounding generative artificial intelligence, and challenges to European competitiveness.
Published weekly on Wednesdays over the course of nine weeks, the column offers an accessible reflection on the centrality of fairness in digital markets, understood as a legal, economic and regulatory criterion. In 21st-century markets, fairness may be perceived either as a regulatory burden or as a factor of competitiveness; it may underpin consumer complaints and requires regulators to provide a clear — albeit complex — definition of the boundary between fair and unfair practices.
The first editions of the series are already available, including the presentation of the “Fair Markets of the 21st Century” column, a piece on FRAND access to data as a factor in European competitiveness, a critical analysis of consumer choice in the digital environment, a reflection on the use of smart contracts for the resolution of disputes relating to digital assets, and a contribution dedicated to the risks associated with the use of artificial intelligence agents in pricing and trading in financial and securities markets.
In the coming weeks, topics such as the data market, digital labour law, the use of artificial intelligence in the justice system, the legal protection of attention, facial recognition in retail, and different perspectives on the regulation of artificial intelligence will be addressed. The final edition will also, for the first time, publish the results of a survey of experts on the main obstacles to the implementation of Fair Markets in the 21st Century and the solutions proposed.
