The Data Act seeks to foster third-party access to data under certain conditions and thereby promote innovation. Certain options regarding the protection of trade secrets and certain IP rights are, however, questionable and need to be tested in practice. At the same time, although the Data Act may incentivize competition in a number of ways, it also remains to be seen whether the proper balance between the various issues at stake will be attained.
