EU Contract Case Law of the CJEU (July 2023-March 2024): What is New

WhatNext.Law held the webinar entitled “EU Contract Case Law of the CJEU (July 2023-March 2024): What is New?”, on 7th June. Collaboratively organized by WhatNext.Law and the NOVA Green Lab, this event showcased and discussed the most important judgments of the Court of Justice of the European Union (CJEU) on contracts from July 2023 to March 2024.

The event was attended and presented by Fabrizio Esposito, NOVA School of Law, Lucila de Almeida, NOVA School of Law and European University Institute, and Elisa Valletta, Bocconi University and University of Ferrara.

Firstly, Professor Fabrizio Esposito led the discussion by introducing the study of EU contract law case law. Next, Professor Lucila de Almeida provided an interesting overview of the CJUE’s body of decisions, explaining the monitoring and selection criteria used to choose the cases. Following this, an in-depth look into the most relevant decisions was given by all three speakers, with the presentation taking a constructive and innovative view of the cases that had the most impact on contracting practices in the European Union between July 2023 and March 2024.

The selected cases of the CJEU played a significant role in shaping contractual practices in the European Union. In less than one year, the Court addressed questions with very practical implications, including some of the following:

  • Can FIFA and EUFA block the Super league project?
  • Can a UCPD violation that received a 1 billion fine in Germany receive a 5 million fine in Italy?
  • Can “filling an online form” ever count as a “signed agreement”?
  • Can a traveller be average and vulnerable at the same time?
  • Is a privacy clause in a standard form GDPR compliant?

The talk was closed with a productive and interesting Q&A session.

This webinar “EU Contract Case Law of the CJEU (July 2023-March 2024): What is New?” offered a comprehensive overview of the latest changes and their significance for the practice and understanding of contract law within the EU legal framework. It was a unique opportunity to examine and discuss the latest developments in contract law within the European Union, providing valuable insights. It contributed to a deeper understanding of recent CJEU rulings and their implications, as well as fostering an engaging dialogue among legal professionals.
